Reporting A Problematic Situation About A Criminal Record Check Or An Unfair Barring Decision

Criminal Record After viewing the results of your DBS check, it is possible to appeal the decision of the Disclosure and Barring Service (DBS) if the following conditions are fulfilled:

If the DBS has made a decision to put you on a list of people that have also been barred from performing certain job roles

If the DBS has included your name along with the list of people that are barred from specific job roles and you would like the DBS to review the decision that was made.

If for some reason or somehow there is a mistake that was made on the DBS check, then you would be entitled to raise a dispute or make an appeal with DBS.

Once the appeal/dispute is made and is successful, then the particular mistake or decision would be amended by the DBS.

Appeals or Disputes can also be lodged by employers or the licensing authority if an only if they have had a word with and taken the confirmation of the applicant.

Dispute a mistake on your DBS certificate

It is entirely possible for the applicant to start a dispute with DBS if they think there has either been a mistake or error in their DBS Application, whether enhanced DBS check or Standard DBS check if there is an error in the details that were given, for instance if you do not have any convictions but it mentions on the report that you do, if there is a mistake/error in personal details such as name or gender or age etc.

When it comes to a Basic DBS check, the steps or the process involved in dispute are slightly different from an Enhanced DBS check.

In the event that there is a mistake in identity details on record, Law officers could request your fingerprints to authenticate and correct the records.

We have mentioned a few details on how to go about raising a dispute

The very first thing to make sure is that you are reporting the mistake/error within 3 months of the date that the certificate was issued.

If there is a mistake on your record you will need to fill in and submit the certificate dispute form.

If there is an error or mistake in any personal info/data then section A of the cert dispute form will need to be filled or you can subsequently call the Customer service team from DBS and they will help you

If you are subscribed to the auto update service provided by DBS and you would like to dispute something like the status of a certificate then you can simply make a call to the customer services team from DBS and they will send you the relevant forms needed.

What or who is the Independent Monitor review/er

The DBS in certain cases works in tandem with the police force in certain cases in order to come to conclusion regarding the DBS check.

If it is the opinion or view of the police to not agree that there actually is a mistake, in certain such cases the dispute will then be sent forward to somebody who is known as the Independent Monitor only.

if the objection that is taken regarding the information is either having no relevance to the Job role that was originally applied for or if certain information should or should not be included in the report

Only if the Independent reviewer agrees with the dispute that has been put forward will the Enhanced DBS check be corrected.

Before any dispute or issue is raised with the Independent Monitor, you will first need to raise a dispute with DBS and see the result of the same.
