Deputy Prime Minister and Commerce Minister Phumtham Wechayachai remarked on the “elephant pants” problem, stating that the copyright for elephant- or cat-patterned pants has now been validated.

He has authorised the Department of Intellectual Property to inspect the market to determine the availability of such products, and the Customs Department to control them at all checkpoints.
Additionally, the Department of International Trade Promotion will coordinate product quality control. It may include emblems or insignia to signify that this product is of Thai origin, in order to promote Thai products.
It is suggested that imported products may be of much inferior quality than Thai-produced products. Products sold at a considerably cheaper price may lack standardised quality and be less durable.
In response, Wutthikrai Leeviraphan, Director-General of the Department of Intellectual Property, stated that preliminary examinations confirmed that elephant pants (กางเกงช้าง), a popular tourist item, are unique designs produced by Thais.
Several people have filed copyright claims with the department. Unauthorised replication or commercial use without the authorization of the copyright holder is strictly forbidden. Authorities will increase inspections in key retail locations, educate traders on the importance of copyright, and advise them to check the provenance of products before selling.
Furthermore, the Intellectual Property Department, in collaboration with the Customs Department, will step up efforts to investigate suspicious imports of goods that may violate copyright laws at Thailand’s borders, not just elephant pants but also other copyrighted designs such as the Korat cat and the Mae Klong mackerel patterns.
The sanctions for copyright violation vary from 20,000 to 200,000 baht. If the infraction is for commercial purposes, punishments might include imprisonment for six months to four years, fines ranging from 100,000 to 800,000 baht, or a combination of both.
