(CTN News) – The Justice Department is challenging the judge’s choice of an impartial arbitrator to review records that the FBI seized from former President Donald Trump’s Florida estate in a process that could shield some of them from a criminal investigation. A U.S. appeals court in Atlanta has scheduled Nov. 22 arguments.

Trump requested that Raymond Dearie be appointed as a “special master” to analyze the papers, and U.S. District Judge Aileen Cannon granted his request in September.

After leaving office last year, Trump is battling the department’s probe into his retention of classified government documents.

The 11th U.S. Circuit Court of Appeals in Atlanta scheduled the hearing date for Tuesday. Dearie is a U.S. district judge, and the department has requested the 11th Circuit to overturn Cannon’s appointment of him.

Dearie’s evaluation, according to the prosecution, is impeding their inquiry.

Additionally, they are requesting access to nearly 11,000 documents that FBI investigators found during the Aug. 8 search of Trump’s Mar-a-Lago property in Palm Beach, which the court authorized.

Two weeks after the search, Trump’s lawyers filed a lawsuit and asked the court to appoint a special master to conduct an impartial assessment of the information. Trump pleaded with the 11th Circuit last week to maintain Dearie’s review.

Later on Tuesday, Trump is anticipated to announce his bid for the presidency in 2024 at Mar-a-Lago.

In September, the 11th Circuit ruled that although Cannon first barred access to the secret files obtained during the search, the Justice Department may start analyzing them.

Trump’s attorneys have claimed that some papers shouldn’t be made available to investigators because they are either private or covered by presidential privilege, a legal theory that permits a president to withhold records or information.
